Terms Of Service

The rules that keep Sundance Professionals fair and useful for candidates and recruiters.

Last updated: October 23, 2026. Sundance Professionals is in early access; these terms may be updated before full launch.

1. Agreement

By creating an account or using Sundance Professionals, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you do not agree, please do not use the platform.

2. Early Access

The platform is currently in early access. Features may change, be paused or contain errors while we prepare for full launch. We appreciate your feedback.

3. Where We Operate

Sundance Professionals is for jobs based in the United States — in-person, hybrid, or remote within the US — filled by people authorized to work in the United States.

  • Candidates are responsible for holding, or being able to obtain, valid authorization to work in the United States. Any work authorization status shown on a profile is self-declared and is not verified by us.
  • Employers are solely responsible for verifying employment eligibility (including Form I-9), for lawful use of work authorization and sponsorship questions, and for following anti-discrimination rules on citizenship and national origin.
  • Employers are responsible for including a good-faith pay range where the law requires it. We require a salary range on US Remote roles and on roles in states with pay transparency laws, but this does not replace your own legal review.
  • We do not support hiring that takes place outside the United States. Employers who use the platform for such hiring do so at their own legal risk and remain solely responsible for local law.
  • We may limit or refuse access in regions where we cannot offer the platform lawfully.

4. Your Account

  • You must be at least 18 and provide accurate information.
  • One person per account; your role (candidate or recruiter) is chosen at sign-up.
  • Keep your password safe. You are responsible for activity on your account.

5. Candidate Responsibilities

  • Represent your skills, experience, education and certifications truthfully.
  • Upload only resumes, photos and files you have the right to share.
  • Apply only to roles you are genuinely interested in.

6. Recruiter & Employer Responsibilities

  • Post only real, currently available positions you are authorized to hire for.
  • Describe pay, location and requirements accurately.
  • Use candidate information only for recruiting, never resell or share it outside your hiring process.
  • Never ask candidates for payment to apply or be hired.

7. Employer Legal Compliance

Employers and recruiters are solely responsible for complying with all employment laws that apply to their roles and candidates, including, where applicable:

  • Equal opportunity: no discrimination based on race, color, religion, sex, pregnancy, sexual orientation, gender identity, national origin, age, disability, genetic information, veteran status or any other protected characteristic (for example Title VII, ADEA and ADA in the United States).
  • Pay transparency: posting good-faith salary ranges where required by state, local or international law.
  • Salary history bans: not asking about or relying on a candidate's past pay where prohibited.
  • Fair chance hiring: not asking about criminal history or running background checks before the stage permitted by applicable law.
  • Reasonable accommodations: responding in good faith to candidates who request accommodations during the hiring process.
  • Automated tool notices: providing any candidate notices or bias audits required by laws that regulate tools used in hiring, where the employer's use of the platform falls under them.

Pre-screening questions and dealbreaker criteria must be job-related and lawful. Dealbreakers only flag answers for the employer to review; they never reject an applicant automatically. Sundance Professionals does not review employer questions for legal compliance.

8. Match Scores & Hiring Decisions

Match scores and their breakdowns are decision-support information only. They compare qualifications a candidate has entered (programming languages, skills, tools and technologies, relevant experience, and education or certifications when requested) with requirements the employer has posted. Only active categories count, with weights normalized to 100%.

  • A match score is not an automated employment decision, a measure of merit or future performance, an endorsement by Sundance Professionals, or a guarantee of contact, interview or employment.
  • A higher score does not mean a better chance of being hired. Many things a score cannot measure — interviews, communication, team needs and timing — shape every decision.
  • The platform never automatically rejects or hides an applicant because of their score. Every applicant remains visible to the employer.
  • When an employer fills every open spot on a job, the job closes and any remaining open applications for it are marked as position filled, and those applicants are notified.
  • All screening, interview, selection and offer decisions are made by employers through their own independent human judgment, and employers are responsible for them.
  • Photos, school or employer prestige, soft skills, salary, location, availability and other personal or logistical details never change a match score. Education contributes only when preferred or required; certifications contribute when listed by the job.

9. Your Content

You keep ownership of the content you add. You give Sundance Professionals permission to store, display and process it only as needed to operate the platform as described in our Privacy Policy.

10. Copyright & DMCA Notices

We respect intellectual property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). Our designated Copyright Agent is: Sundance Professionals, Attn: Copyright Agent, legal@sundanceprofessionals.com.

A valid notice must include:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you claim is infringed.
  • Identification of the material on the platform you want removed, with enough detail (such as a link) for us to find it.
  • Your name, address, telephone number and email address.
  • A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.

If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address with the information required by 17 U.S.C. § 512(g). We may restore the content after 10–14 business days unless the claimant tells us they have filed a court action. We close the accounts of repeat infringers in appropriate circumstances.

11. Confidential Information

  • Confidential job postings hide the hiring company's identity from candidates until the employer chooses to reveal it.
  • Interview scorecards, team notes, hiring team feedback and reference answers are employer work product and are never shown to candidates.
  • Recruiters must not disclose a candidate's job search to their current employer or any third party.

12. Prohibited Use

  • Fake profiles, fake jobs, scams or impersonation.
  • Harassment, discrimination, spam or unsolicited promotion.
  • Scraping, copying data in bulk, or trying to bypass security or access rules.
  • Uploading malware or illegal content.

13. Moderation & Suspension

Anyone can report a profile, job or conversation. Moderators may review reports, pause job postings, or suspend accounts that break these Terms or our Community Guidelines, with or without prior notice where safety requires it.

14. Ending Your Account

You can permanently delete your account at any time in Settings. We may end access for serious or repeated violations.

15. Not An Employer Or Sponsor

  • Sundance Professionals is a software and communications platform. We are never an employer, joint employer, employer of record, professional employer organization, staffing agency or employment agency for any user.
  • We do not sponsor visas, verify work authorization or immigration status, or handle payroll, taxes, benefits or worker classification. These are solely the responsibility of the employer and the candidate.
  • Employers hiring across borders must do so through their own legal entities, compliant contractor arrangements or an authorized employer-of-record provider.

16. Sanctions & Export Controls

By using the platform you confirm that you are not located in, ordinarily resident in, or organized under the laws of any country or region subject to comprehensive US sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk and Luhansk regions of Ukraine), and that you are not named on, or owned or controlled by anyone named on, any US government restricted-party list, including the OFAC Specially Designated Nationals list.

You will not use the platform to export, share or receive information in violation of US export control or sanctions laws. We may suspend or close any account immediately, without notice, where we believe these laws may be breached.

17. Disclaimers & Liability

Sundance Professionals is a software platform, not an employer, staffing agency or employment agency. The platform is provided "as is". We do not employ candidates or guarantee jobs, hires or the accuracy of user-provided information. To the extent allowed by law, Sundance Professionals is not liable for indirect or consequential losses arising from use of the platform, or for hiring decisions made by employers.

18. Indemnification

To the extent allowed by law, you agree to defend and hold Sundance Professionals harmless from claims arising from your misuse of the platform, your content, or — for employers — your hiring practices and decisions.

19. Governing Law & Disputes

  • Governing law: These Terms are governed by the laws of the State of Delaware and applicable US federal law, without regard to conflict-of-law rules.
  • Informal resolution first: Before filing any claim, you agree to email support@sundanceprofessionals.com and try in good faith to resolve the dispute informally for at least 60 days.
  • Exclusive venue: Any dispute not resolved informally will be brought only in the state or federal courts located in Delaware, and you consent to their jurisdiction.
  • Individual claims only: To the extent allowed by law, disputes will be handled individually, not as a class, collective or representative action, and you and Sundance Professionals each waive any right to a jury trial.
  • Nothing here removes rights that the law of your country of residence does not allow to be waived.

20. Changes To These Terms

We may update these Terms. Continued use after changes take effect means you accept the updated Terms.
